Terms of Service for Moïchi

1. Acceptance of Terms

By downloading, installing, or using the Moïchi iOS application (« the App »), you agree to be bound by these Terms of Service (« Terms »). If you do not agree to these Terms, do not use the App.

2. Description of Service

Moïchi is a minimalist journaling application that allows users to:

  • Create daily journal entries with text and hand-drawn mood sketches
  • View and manage their journal entries in a calendar format
  • Access a 14-day rolling history for free
  • Unlock unlimited history access through a one-time premium purchase
  • Export their journal entries to PDF format

3. License and Usage Rights

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices that you own or control, solely for your personal, non-commercial use.

3.2 Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Attempt to circumvent any security features or access restrictions
  • Distribute, sublicense, or transfer the App to any third party

4. Premium Purchase

4.1 Purchase Terms

Moïchi offers a one-time premium purchase that unlocks unlimited access to your journal history. The premium purchase:

  • Is a lifetime purchase (no subscription)
  • Is non-refundable except as required by applicable law or Apple’s refund policy
  • Is processed by Apple through the App Store
  • Is tied to your Apple ID and can be restored on other devices using the same Apple ID

4.2 Pricing

Premium pricing is displayed in the App and may vary by region. All purchases are in your local currency and subject to Apple’s App Store pricing policies.

4.3 Refunds

All purchases are final. Refund requests must be submitted directly to Apple through the App Store, as we do not process payments. Apple’s refund policy applies to all transactions.

5. User Content and Ownership

5.1 Your Content

You retain all rights to the journal entries, text, and drawings you create in the App (« Your Content »). We do not claim any ownership rights to Your Content.

5.2 Data Storage

Your Content is stored locally on your device using Apple’s SwiftData framework. We do not have access to Your Content, and we do not store Your Content on our servers.

5.3 Responsibility for Content

You are solely responsible for Your Content. You represent and warrant that:

  • You own or have the necessary rights to Your Content
  • Your Content does not violate any third-party rights
  • Your Content complies with applicable laws and regulations

6. Data Backup and Loss

Since all data is stored locally on your device:

  • Backup Responsibility: You are responsible for backing up your data. We recommend enabling iCloud Backup on your device.
  • Data Loss: We are not responsible for any data loss resulting from device failure, app deletion, iOS updates, or any other cause.
  • Export Feature: You can export your journal to PDF format to create manual backups.

7. Disclaimer of Warranties

THE APP IS PROVIDED « AS IS » AND « AS AVAILABLE » WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • That the App will be uninterrupted, error-free, or secure
  • That defects will be corrected
  • That the App is free of viruses or other harmful components

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, revenue, or business opportunities
  • Damages resulting from your use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PREMIUM PURCHASE, IF ANY.

9. Intellectual Property

The App, including its design, features, functionality, text, graphics, and code, is owned by Waikuu and protected by copyright, trademark, and other intellectual property laws. Moïchi and its logo are trademarks of Waikuu.

10. Third-Party Services

The App uses Apple’s services including:

  • App Store: For distribution and purchases
  • StoreKit 2: For in-app purchase processing
  • SwiftData: For local data storage
  • PencilKit: For drawing functionality

Your use of these services is subject to Apple’s terms and policies.

11. Termination

We reserve the right to:

  • Terminate or suspend your access to the App at any time, with or without cause
  • Discontinue the App or any features at any time

Upon termination:

  • Your license to use the App terminates immediately
  • You must delete the App from all your devices
  • Your local data will be deleted when you uninstall the App

12. Updates and Modifications

We may:

  • Update the App to add features, fix bugs, or improve performance
  • Modify these Terms at any time by updating this page
  • Notify you of material changes through the App or via email

Your continued use of the App after changes constitutes acceptance of the updated Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of France, without regard to conflict of law principles. Any disputes shall be resolved in the courts of France.

14. Apple App Store Requirements

You acknowledge that:

  • These Terms are between you and Waikuu, not Apple
  • Apple has no obligation to provide support for the App
  • Apple is not responsible for any claims relating to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
